मौलिक अधिकारों तथा राज्य नीति के निर्देशक सिद्धान्तों में निम्नलिखित मूल अन्तर हैं-

मौलिक अधिकार न्याय योग्य हैं, परन्तु निर्देशक सिद्धान्त न्याय योग्य नहीं हैं। इससे भाव यह है कि यदि सरकार नागरिक के किसी मूल अधिकार का उल्लंघन करती है तो नागरिक न्यायालय का दरवाजा खटखटा सकता है, परन्तु निर्देशक सिद्धान्त की उल्लंघना होने की स्थिति में सरकार पर दबाव नहीं डाला जा सकता।

भारतीय संविधान निर्माताओं ने संविधान का निर्माण करते समय मौलिक कर्तव्यों को संविधान में सम्मिलित नहीं किया था, परन्तु 42वें संवैधानिक संशोधन द्वारा मौलिक कर्तव्यों को संविधान में सम्मिलित किया गया जिनकी संख्या 10 थी, लेकिन 86वें संविधान संशोधन अधिनियम (2002) द्वारा इसमें एक और बिन्दु जोड़ा गया। अतः अब इनकी संख्या 11 हो गई है

दहेज प्रथा आज जिस विकृत रूप में व्याप्त है, उसके प्रमुख कारण इस प्रकार हैं।

⦁    अनुलोम विवाह अनुलोम विवाह के चलन से उच्च कुलों के घर की माँग बड़ती गई। उच्च कुलो के लड़कों के पिता ऐसी स्थिति में बड़ी धनराशि की मांग करने लगे।

⦁    अत्तर्विवाह अन्तविवाह के नियम के कारण किसी भी कन्या का विवाह जुम की जाति अथवा उपति पर। के शाप होना आवश्यक हो गया। इस कारण विवाह का क्षेत्र सीमित हो गया। योग्य वरों की कम संख्या में दहेज को बढ़ावा दिया।

⦁    विवाह की अनिवार्यता कन्या विवाह को अनिवार्य मान गया है। इसलिए उनका विवाह करना जरूरी हो गया। धीरे धीरे योग्य वरो की तलाश में धन को खर्च किया जाने लगा।

दहेज शब्द अरबी भाषा के बहे शब्द से रुपान्तरित हुआ है, जिसका अर्थ है-सौगात्। विवाह के अवसर पर कन्या पक्ष द्वारा वर पक्ष को दिया जाने वाला इन, सम्पत्ति और सामान ल्यादि को दहेज कहा जाता हैं। दहेज को उर्दू में जहेज़ कहते हैं। इसे हुण्डा या वरदक्षिणा आदि नामों में से भी जाना जाता हैं। वेव्सटर शब्दकोश के अनुसार, “दहेज वह पन, वस्तु अशा सम्पत्ति है, जो एक र विवाह के समय पति के लिए सातो हैं।”

निवारक निरोध

अनुच्छेद 22 के खण्ड 4 में निवारक निरोध (Preventive Detention) का उल्लेख किया गया है। निवारक निरोध का तात्पर्य वास्तव में किसी प्रकार का अपराध किए जाने के पूर्व और बिना किसी प्रकार की न्यायिक प्रक्रिया के ही किसी को नजरबन्द करना है। निवारक निरोध के अन्तर्गत किसी व्यक्ति को तीन माह तक नजरबन्द रखा जा सकता है। इससे अधिक यह अवधि परामर्शदात्री परिषद् की सिफारिश पर बढ़ाई जा सकती है। निवारक निरोध अधिनियम, 1947 ई० में पारित किया गया था। समय-समय पर इसकी अवधि बढ़ाई जाती रही और वह 1969 ई० तक चलता रहा। 1971 ई० में इसका स्थान ‘आन्तरिक सुरक्षा अधिनियम’ (Maintenance of Internal Security Act, 1971) ने ले लिया। इस कानून को बोलचाल की भाषा में ‘मीसा’ (MISA) के नाम से जाना जाता है। इसके पश्चात् 1981 ई० में इसके स्थान पर राष्ट्रीय सुरक्षा कानून’ (National Security Act) पारित किया गया। तत्पश्चात् टाडा कानून’ (Terrorist and Disruptive Activities Act) लागू किया गया। वर्तमान में यह भी समाप्त कर दिया गया है और इसके स्थान पर पोटा (Prevention of Terrorist Act) का निर्माण किया गया है। अब इसे भी संशोधित करने की प्रक्रिया चल रही है।

निवारक निरोध कानून की आलोचना और उसका महत्त्व

स्वतन्त्रता के अधिकार पर लगे प्रतिबन्धों को देखकर अनेक विद्वानों ने इसकी आलोचना की है। निवारक निरोध कानून के विषय में टेकचन्द बख्शी ने कहा था कि यह दमन तथा निरंकुशता का पत्र है। इसी प्रकार सोमनाथ लाहिड़ी ने इसकी आलोचना करते हुए कहा था, “मूल अधिकारों का निर्माण पुलिस के सिपाही के दृष्टिकोण से किया गया है, स्वतन्त्रता के लिए संघर्ष करने वाले राष्ट्र के दृष्टिकोण से नहीं।” परन्तु निवारक निरोध अथवा मीसा की आलोचना के बावजूद भी इस बात से इनकार नहीं किया जा सकता कि वर्तमान परिस्थितियों में यह व्यवस्था कुछ सीमा तक आवश्यक और उपयोगी है। न्यायमूर्ति पतंजलि शास्त्री के अनुसार, “इस भयावह उपकरण की व्यवस्था ……………. उन समाज-विरोधी और विध्वंसकारी तत्त्वों के विरुद्ध की गई है, जिनसे नवविकसित प्रजातन्त्र के राष्ट्रीय हितों को खतरा है।” वस्तुत: निवारक निरोध की व्यवस्था एक ‘भरी हुई बन्दूक’ के समान है और उसका प्रयोग बहुत सावधानी से तथा विवेकपूर्ण ही किया जाना चाहिए।

भारतीय लोकतन्त्र की सफलता नीति-निदेशक तत्त्वों के लागू करने में निहित है। भारत सरकार ने पिछले 57 वर्षों में निदेशक तत्त्वों को प्रभावी बनाने के लिए अनेक कानून व योजनाएँ लागू की हैं। आर्थिक विकास के लिए पंचवर्षीय योजनाओं को अपनाया गया ताकि निदेशक तत्त्वों में निहित उद्देश्यों को प्राप्त किया जा सके। गरीबी और आर्थिक असमानता को दूर करने के लिए 20-सूत्री कार्यक्रम लागू किया गया। ग्रामीण अंचलों में शिक्षा व स्वास्थ्य का प्रसार किया गया है। विश्व शान्ति व अन्तर्राष्ट्रीय सहयोग को बढ़ावा दिया गया है। इन समस्त नीतियों का उद्देश्य निदेशक तत्त्वों द्वारा घोषित लक्ष्य लोक-कल्याणकारी राज्य की प्राप्ति है। 

लेकिन इन नीतियों से किस सीमा तक नीति-निदेशक तत्त्व प्राप्त हो पाए हैं? यह तथ्य केवल एक ही ओर संकेत करता है कि अभी यथार्थ में नीति-निदेशक तत्त्वों को प्राप्त नहीं किया जा सका है। आर्थिक क्षेत्र में पंचवर्षीय योजनाओं को अपनाने के बावजूद भी भौतिक साधनों पर केन्द्रीकरण कम नहीं हुआ। है। अमीर अधिक अमीर हुआ है तथा गरीब और अधिक गरीब निःशुल्क शिक्षा, समान आचार संहिता के निदेशक तत्त्व मृग मरीचिका बन चुके हैं। मुफ्त कानूनी सहायता के निदेशक तत्त्व के बावजूद न्याय-प्रणाली बहुत महँगी है। कुटीर उद्योग-धन्धों को बड़े औद्योगिक कारखानों ने वैज्ञानिक प्रगति के नाम पर निगल लिया है। मद्यनिषेध को राजस्व-प्राप्ति हेतु बलि का बकरा बना दिया गया है।

राज्य के नीति-निदेशक सिद्धान्तों को न्याययोग्य या वादयोग्य क्यों नहीं पाया गया – प्रश्न यह उत्पन्न होता है कि जब राज्य-नीति के निदेशक सिद्धान्त भारतीय नागरिकों के जीवन के विकास तथा लोकतन्त्र की सफलता के लिए इतने महत्त्वपूर्ण हैं तो इन्हें भी मौलिक अधिकारों की तरह वादयोग्य क्यों नहीं बनाया गया? ऐसा होने पर कोई भी सरकार इन्हें अनदेखा नहीं कर सकती थी। परन्तु ऐसा करना सम्भव नहीं था क्योंकि इन्हें लागू करने में धन की बड़ी आवश्यकता थी और देश जब स्वतन्त्र हुआ तो आर्थिक दशा अच्छी नहीं थी। इसलिए यह बात सरकार पर ही छोड़ दी गई कि जैसे-जैसे सरकार के पास धन तथा दूसरे साधन उपलब्ध होते जाएँ, वह इन्हें थोड़ा-थोड़ा करके लागू करती जाए। मौलिक अधिकारों की तरह इन निदेशक सिद्धान्तों को पूर्ण रूप से उस समय लागू करना व्यावहारिक कदम नहीं था।

राष्ट्रीय मानवाधिकार आयोग में उच्चतम न्यायालय का एक पूर्व न्यायाधीश, किसी उच्च न्यायालय का एक पूर्व मुख्य न्यायाधीश तथा मानवाधिकारों के सम्बन्ध में ज्ञान या व्यावहारिक अनुभव रखने वाले दो और सदस्य होते हैं।

मानवाधिकारों के उल्लंघन की शिकायतें मिलने पर राष्ट्रीय मानवाधिकार आयोग स्वयं अपनी पहल पर या किसी पीड़ित व्यक्ति की याचिका पर जाँच कर सकता है। जेलों में बन्दियों की स्थिति का अध्ययन करने जा सकता है, मानवाधिकार के क्षेत्र में शोध कर सकता है या शोध को प्रोत्साहित कर सकता है। आयोग को प्रतिवर्ष हजारों शिकायतें प्राप्त होती हैं। इनमें से अधिकतर हिरासत में मृत्यु, हिरासत के दौरान बलात्कार, लोगों के गायब होने, पुलिस की ज्यादतियों, कार्यवाही न किए जाने, महिलाओं के प्रति दुर्व्यवहार आदि से सम्बन्धित होती हैं। मानवाधिकार आयोग का सर्वाधिक प्रभावी हस्तक्षेप पंजाब में युवकों के गायब होने तथा गुजरात-दंगों के मामले में जाँच के रूप में रहा। आयोग को स्वयं मुकदमा सुनने का अधिकार नहीं है। यह सरकार या न्यायालय को अपनी जाँच के आधार पर मुकदमे चलाने की सिफारिश कर सकता है।
